The county commissioners charged McElfish with obstructing a public highway and also swore out a peace warrant against McElfish and his son Russell. They were arrested and taken before Justice Wolford this morning. The obstruction charge was sent to the grand jury due to jurisdictional points of the law. 08 Aug 1901 Philip McElfish has applied for an injunction restraining the county commissioners from reopening a portion of what is known as the old Hancock Road, which suit grows out of what is know as the Mason road suit. O'NEAL 15 Nov 1901 Constable Hendrickson went out the Baltimore Pike yesterday for the purpose of bringing in the children of a destitute family of George O'Neal and having them sent to an institute. At the home, 5 children flocked about the mother and pleaded to remain with her. The father of the children is in an insane asylum. The constable returned to Judge Potter empty handed and then went out to collect sufficient clothing to keep them warm and enough groceries to keep them from starving for days to come. 30 Nov 1901 Glissan Porter, Esq. Went to the home of George O'Neal on the Baltimore Pike to see Mrs O'Neal preparatory to filing a petition to have her husband released from the Sylvan Retreat Asylum. The imprisoned man alleges he is the victim of his brother and will fight for liberty. 09 Dec 1901 Glissan Porter, Esq. Filed a writ of Habeus Corpus in the case of George O'Neal who is confined in the asylum here. The writ alleges that O'Neal is held unjustly, having been adjudged a pauper and lunatic on Nov 1 by a jury. It further alleges that since his incarceration, O'Neal has displayed no signs of insanity and asks the court to inquire into his present mental condition. 16 Dec 1901 Judge Boyd is undecided whether to parole George O'Neal from the asylum or have him sent to another institution for treatment and continued the case for next Saturday. The court further directed the asylum to give O'Neal more liberty and an opportunity for work. The bulk of the testimony was to the effect that O'Neal was weak minded and not dangerous. The court further directed that Albert O'Neal, who instituted lunacy proceedings against his brother, to see to it that Mrs O'Neal was kept provided with firewood pending her husband's incarceration. 21 Dec 1901 The petition of habeus corpus to release Mr George O'Neal from the asylum was dismissed by Judge Boyd on the basis that his commitment was determined by a jury of 12 and his power to discharge that decision is restricted unless recovery has been shown or an illegal confinement. He recommends, based upon the evidence submitted, that Mr O'Neal be sent to a suitable institution as the asylum is not a proper place for him. 24 Dec 1901 The law was too slow for George O'Neal, the man incarcerated in Sylvan Retreat, over whose confinement there has been much contention. He has escaped the institution and now is with his wife and family. The additional liberty he enjoyed, offered an opportunity to escape and be with his family for Christmas. No action was taken in his case this morning by the County Commissioners. 28 Dec 1901 George O'Neal has been paroled from the Sylvan Retreat by the County Commissioners. ROSE HILL 23 Aug 1901 Reprint from the Hyndman PA "Bulletin", under the caption " A Trip To Cumberland", by editor Wilbur F Cleaver and Capt. Jere Stell, a conductor on the Bedford division of the Pennsylvania RR as his guide. It reads in part.... Rose Hill is a beautiful city of the dead and contains many magnificent monuments. In the cemetery is a tree brought many years ago by Judge Pearre from Jerusalem. Growing from the trunk and branches are clusters of long thorns and it is claimed that this is the kind of tree from which the crown of thorns was made that was pressed on the head of the Savior while on the way to the crucifixion. From the manner in which the clusters can be broken from the tree and the way the thorns can be twisted, it seems probable that this is correct. The suffering that this would cause would be terrible. The leaves on the tree resemble ferns. There are also long pods, some of which are two feet long, in which are beans. These pods are said to be the husks eaten by the prodigal son while attending swine. Adjoining Rose Hill Cemetery is the German Catholic Cemetery. In it there is a small pavilion in which there is a large cross upon which there is a life sized representation of Christ in life color. The ground surrounding it is holy ground and is only entered by a priest who visits once a year in his bare feet to perform certain rites... YAIDER 28 Dec 1901 The Yaider-Roland feud spills over to affect Charles Davis and Charles Twigg, two Oldtown boys who spent the evening with girl friends at Rush. The Yaider boys alleged that they were allies with the Rolands and laid in wait for them. Davis rushed into the home of Jesse Robinette and Mrs Robinette held off the boys, not allowing them to molest him. Twigg left his buggy and ran to the home of Thomas Furlow, 6 miles away. About midnight, Davis left the safety of the Robinette home but was accosted by the Yaiders on horseback a mile away and beat him until the cries were heard at Rush. A citizen came to his aid and was also beaten by the Yaider men. The assaulted boys were afraid to swear out warrants. ( Article has 5 paragraphs)
